Please read these terms and conditions carefully before using the Pinacasa platform.

Definitions

• "Platform": The Pinacasa website and all its associated services
• "User": Any person who accesses or uses the Platform
• "Review": Opinion or review published by a User about a property or landlord
• "Content": All information, text, images or other material published on the Platform

Acceptance of terms

By accessing and using the Platform, you agree to be bound by these terms and conditions. If you do not agree with any part of these terms, you may not access the service.

Service description

Pinacasa is a platform that allows users to:

• Search for rental properties
• Publish reviews about properties and landlords
• View reviews from other users
• Access aggregated information about the rental market

User registration and account

Requirements

• You must provide truthful information
• You must consider the legality of the content of comments made.
• You are responsible for maintaining the confidentiality of your account

Publishing reviews

Review requirements

By publishing a review, you declare and warrant that:

• You have had a real and direct experience with the property or landlord being reviewed
• The information provided is truthful and accurate to the best of your knowledge
• You have no conflicts of interest that affect your objectivity
• You are not publishing defamatory, false or malicious content

Prohibited content

It is strictly prohibited to publish:

• False or misleading information
• Defamatory, injurious or slanderous content
• Third party personal data without their consent
• Content that incites hatred, violence or discrimination
• Advertising or spam
• Content that infringes intellectual property rights
• Illegal content or content that promotes illegal activities

Moderation

We reserve the right to:

• Review, edit or remove any review that violates these terms
• Suspend or cancel accounts of users who repeatedly violate the rules
• Implement review verification systems

Intellectual property

Of the Platform

All intellectual property rights over the Platform (design, code, brand, etc.) belong to Pinacasa or its licensors.

Of user content

By publishing content, you:

• Retain ownership of your content
• Grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify and display such content in connection with the service
• Warrant that you have the necessary rights to grant this license

Limitation of liability

Third-party information

Reviews are opinions of individual users. Pinacasa does not guarantee the truthfulness, accuracy or completeness of published reviews.

Service availability

The service is provided "as is" and "as available". We do not guarantee that the service will be uninterrupted, secure or error-free.

Exclusion of damages

To the maximum extent permitted by law, Pinacasa shall not be liable for:

• Indirect, incidental or consequential damages
• Loss of profits, data or use
• Decisions made based on information from the Platform

Indemnification

You agree to indemnify and hold Pinacasa harmless from any claim, damage or expense arising from:

• Your use of the Platform
• Your violation of these terms
• Your violation of third-party rights

Right of reply

Landlords and property owners have the right to:

• Respond to reviews received
• Request review of reviews they consider inaccurate or defamatory
• Verify their identity to obtain a "Verified Landlord" badge, a feature not yet implemented but for which we already accept requests.

Modifications

We reserve the right to modify these terms at any time. Changes will take effect upon publication on the Platform. Continued use of the service constitutes acceptance of the modified terms.

Termination

We may terminate or suspend your access immediately, without prior notice, for any reason, including breach of these terms.

Applicable law

These terms are governed by the laws of the Netherlands. Any dispute will be submitted to the courts of Tilburg.
